An attorney says his client is about to be charged in connection to the bizarre murder of a pizza delivery man who robbed a bank with a bomb strapped to his neck four years ago in Erie.
Federal public defender Thomas Patton says his client Marjorie Diehl-Armstrong will be charged in the case of Brian Wells, the man who died.
He wants a judge to stop investigators from holding a news conference later this week t o announce the indictment.
Diehl-Armstrong is already in jail in the murder of her boyfriend in 2003, the same year Wells died with a homemade bomb strapped around his neck.
Investigators were able to determine that someone called in a fake pizza delivery order and when Wells showed up, they put the bomb on his neck and forced him to rob a bank.
Wells was instructed to deliver the pizza to a TV tower located near the house where Diehl-Armstrong's boyfriend's body was found stuffed in a freezer.
The owner of that house has since died.
Investigators have questioned Diehl-Armstrong several times since the bombing, but until now, no one had ever been charged.
A federal source tells the Associated Press that they will hold a news conference on Wednesday, unless a judge orders them not to.
The attorney for Diehl-Armstrong says she's guilty of nothing more than knowing some of the people who might have been involved in this case.
