Roethlisberger Seeks Damages Against Accuser

PITTSBURGH (KDKA) ― Ben Roethlisberger is now seeking counter damages from the woman he says falsely accused him of rape.

Andrea McNulty sued Roethlisberger in July alleging that he sexually assaulted her in his hotel room at Harrah's in Lake Tahoe where she worked.

Roethlisberger's attorney claims McNulty made the story up, claiming she had a plan to seduce him and acted voluntarily at all times when she was in his room.

Last month, a Nevada judge denied motions by Roethlisberger's lawyers to dismiss the civil suit against him.

"The court recognizes that a motion to dismiss is only proper where it appears beyond doubt that the plaintiff could prove no set of facts which, if true, would entitle them to relief," Washoe District Judge Brent Adams wrote.

The lawsuit says at a celebrity golf tournament in Lake Tahoe in July 2008, Roethlisberger met McNulty, an executive casino host in charge of hospitality on the penthouse floor at Harrah's.

The woman says the rape took place in Roethlisberger's room after he called her on a bogus complaint about the television.

In July, Roethlisberger called the woman's claims "reckless and false."
