Lawmaker Wants Smoking With Kids In Car Banned

HARRISBURG (KDKA) ― A local lawmaker may introduce a bill that would prohibit drivers from smoking in their vehicle when their children are inside.

Representative Peter Daly's proposal calls for offenders to be punished by a $100 fine the first time and at least $250 each additional time.

But it doesn't apply to all children -- only those in a car seat.

Under state law, that means those under the age of eight or below 80 pounds.

The smoking ban is already law in Louisiana and Arkansas.

States including New York, New Jersey, and West Virginia are also considering similar bills.

Daley introduced a similar bill back in 1988.
