Testimony Goes On In Lawsuit Case Over Boy's Death

PITTSBURGH (KDKA) ― The trial continues today in the lawsuit against two state troopers connected to the fatal shooting of a 12-year-old boy in Uniontown back in 2002.

Officials say the boy, Michael Ellerbe, was shot while running from the two troopers, who had stopped him in a stolen SUV in December 2002.

Ellerbe's father filed the suit in 2003, accusing the troopers of using excessive force.

On Wednesday, a former sheriff from Florida took the stand and said the two local state troopers violated national training standards.

One of those troopers, Juan Curry said his gun went off accidentally while he was scaling a fence. The other trooper Samuel Nassan said he then shot Ellerbe because he thought the boy had fired at his partner.
