Controversial Tape Played At Wrongful Death Trial

PITTSBURGH (KDKA) ― A controversial audio tape was played today at the wrongful death lawsuit trial of a 12-year-old Uniontown boy.

Michael Ellerbe was shot and killed in December of 2002 during a chase involving two state troopers.

One of those troopers, Juan Curry said his gun went off accidentally while he was scaling a fence. The other trooper, Samuel Nassan, said he then shot Ellerbe because he thought the boy had fired at his partner.

On the tape played today in court, Nassan talked about his decision during an interview with investigators.

On the stand today, the trooper's supervisor at the time of the shooting said he thought Nassan's explanation of what happened was adequate.

The plaintiffs expect to wrap up their side of the case early next week.
