Local Doctor Facing New Sexual Assault Charges

BUTLER (KDKA) ― A local doctor that is already charged with sexually assaulting a teenage boy in the previous decade, was in court today to face new charges.

Two more boys, ages 15 and 17, claim Dr. David Evanko sexually assaulted them in his office in Butler this year.

The younger boy claims he was assaulted last year, while the older boy said he was assaulted earlier this year.

They testified they were touched inappropriately during a medical examination.

Dr. Evanko had a contract with the academy to provide medical examinations for students.

Evanko's attorney Dave DeFazio argues the students were examined properly.

"The fact that they may have felt uncomfortable or in their limited view think that he didn't do it according to the proper way is irrelevant," DeFazio said.

"Who cares what they thin? The commonwealth should have had a doctor here today offering an expert opinion as to whether or not Dr. Evanko's treatment procedures were proper or not and they failed to do that," he added.

Evanko has been charged with two counts each of institutional sexual assault, indecent assault, unlawful contact with a minor and corruption of minors.

The school is for juvenile offenders near Butler. DeFazio plans to question the students' credibility.

"I'm looking forward to getting these two young men on the witness stand in front of the jury where the questions I've asked can be asked," DeFazio said. "I asked, 'What brings you to Summit Academy? I understand the facility is for juvenile offenders.'

"I'm going to go into their credibility. I'm going to go into their entire background."

Dr. Evanko faces trial in an unrelated sexual assault case involving a former Boy Scout who is now 29 years old.

It appears that case is stalled in court because several judges have recused themselves from the case. Dr. Evanko is very well-known in Butler County.
