Constable In Court For Storming Wrong Home

MCKEESPORT (KDKA) ― A constable accused of breaking into the wrong house in McKeesport was in court.

Mark Smith says he was sitting at home when the men dressed in black kicked in his door.

Constable Derek Yasser says he did nothing wrong and was just doing his job.

Smith tells a different story.

"They came out to my house they had all those guns drawn on me. I've never had that situation before," Smith said.

According to police reports and photographs of the scene, constables came into Smith's house with a child support warrant and kicked in the door.

The reports indicate the victim was not the person they were looking for. It also says constables did not notify the police department of serving any warrants in the McKeesport area.

The mix-up and the panic had Smith ready to shoot what he believed to be intruders in his home.

In court Thursday, the constables indicated they realized Smith was not the man they were looking for and just left.

They also indicated they had to kick in his door because he would not respond to them.

Meantime, Smith says the incident has left him paranoid.

"With them banging on the door and kicking my door in and just invading my home that was my sanctuary," he said. "I was raising my child there - I've lived there all my life and it's just a weird feeling when somebody does that."

McKeesport Police withdrew the original criminal mischief charge filed against the constable.

The judge indicated police plan to file a more serious charge – a different degree of criminal mischief at another time.
